U.S. Attorney Opens Criminal Probe of Qwest Communications

The U.S. Attorney's office in Denver has begun a criminal investigation of Qwest Communications International Inc. , the beleaguered local and long-distance operator said Wednesday.
Further details weren't available. In a brief statement, Qwest said the attorney's office didn't disclose the subject matter of the investigation.
The company has been under a cloud of suspicion about the way it has booked revenue.
Qwest said it was notified of the criminal probe late Tuesday and that it will cooperate with authorities.
The news sent shares of Qwest down 97 cents, or 37.31%, to $1.63 at AH trading on the New York Stock Exchange.
The Wall Street Journal, citing people close to the situation, reported last week that Qwest was the focus of a criminal probe. At the time, Qwest said it was unaware of any Justice Department investigation.
"We have no reason to believe that we are the subject of any investigation by the Department of Justice," Drake S. Tempest, Qwest general counsel, said last week. "It is outrageous that we would learn about an investigation in this way."
The Securities and Exchange Commission already is investigating Qwest's accounting practices, particularly how it booked revenue in 2000 and 2001.
The company was one of the most aggressive users of "swap" transactions -- selling long-term capacity on its fiber network to another carrier, buying the same amount of fiber on another carrier's network and then booking the contract as revenue.
The practice boosted Qwest's revenue by more than $1 billion in 2001, according to filings with the SEC.
The SEC is investigating whether Qwest may have violated accounting rules by booking the swap deals all at once instead of over a period of years that reflected the life of the contract.
The Journal reported Monday that Qwest denied any wrongdoing regarding its accounting practices and defended the one-time capacity sales as legitimate moves to take advantage of demand from customers.
